Los Códigos de Buenas Prácticas.
Los Códigos de Buenas Prácticas, y la normativa que los desarrolla, son un compendio de medidas legales que se han publicado para la protección de deudores hipotecarios que se encuentran en situaciones de dificultad social y económica, provocadas por circunstancias externas de carácter extraordinario y complejo.
Disponemos de dos Códigos de Buenas Prácticas. La inmensa mayoría de entidades financieras, entre ellas las más conocidas, se han adherido voluntariamente a los citados Códigos, por lo que están obligadas a aplicar las medidas de protección previstas en estos si los deudores cumplen las condiciones para poder acogerse.
Desde principios del año 2012, disponemos del primer Código de Buenas Prácticas, que se estableció por el Real Decreto-ley 6/2012, de 9 de marzo, de manera consensuada con las propias entidades financieras, y que entró en vigor para intentar paliar las dramáticas situaciones sociales que suponían los numerosos procesos de ejecución hipotecaria y los desahucios en que desembocaban, en el contexto de la profunda crisis económica que se inició en España durante el 2008.
La profunda crisis económica que atravesó España y que se había iniciado unos cuatro años antes de la publicación de este primer Código de Buenas Prácticas, había dado como consecuencia situaciones prolongadas de desempleo o de ausencia de actividad económica en general, por lo que las familias, en un gran número, dejaron de atender el cumplimiento de sus obligaciones de pago derivadas de los préstamos o créditos hipotecarios que tenían concedidos, en numerosas ocasiones con la consecuencia de la pérdida de su vivienda habitual y, además, con la persistencia de una parte de la deuda hipotecaria.
En este primer Código, modificado reiteradamente y ampliados progresivamente los supuestos de aplicación y las medidas aplicables, se establecen diversos mecanismos para la restructuración de la deuda hipotecaria de quienes padecen extraordinarias dificultades para atender su pago, así como la flexibilización del proceso de ejecución hipotecaria, conducentes a evitar que el segmento de la población más desfavorecida quede privado de su vivienda, permitiendo su derecho a disfrutar de una vivienda digna y adecuada, sin deteriorar, no obstante, los elementos fundamentales de la garantía hipotecaria de nuestro sistema hipotecario.
El modelo de protección incluye tres fases de actuación. La primera, dirigida a procurar la reestructuración viable de la deuda hipotecaria. La segunda, potestativa, de ofrecimiento de una quita sobre el conjunto de la deuda. Y la tercera, en el supuesto de que las anteriores no resulten viables, consistente en la dación en pago como medio liberatorio definitivo de la deuda.
A finales del año 2022, entró en vigor el reciente Código de Buenas Prácticas establecido por el Real Decreto-ley 19/2022, de 22 de noviembre, y su normativa complementaria, como respuesta al alza acelerada de los tipos de interés.
El contexto internacional, marcado principalmente por la agresión militar de Rusia contra Ucrania, provoca una intensa subida de los precios a nivel global, empujada por el incremento de los precios energéticos y de los alimentos, que motiva una subida de los tipos de interés de referencia en la zona euro, entre ellos el del euríbor, principal índice de referencia al que están referenciadas 3,7 millones de hipotecas en España. Esta alza provoca un fuerte aumento en las cuotas hipotecarias mensuales de las familias, que puede extenderse durante meses a medida que se produzcan las revisiones periódicas correspondientes de los tipos de interés.
Este nuevo Código aporta un paquete de nuevas medidas que amplían el catálogo de medidas y de opciones existente, y que persigue aliviar la carga hipotecaria por el incremento del Euríbor, como dice el propio texto legal ‘por el alza acelerada de los tipos de interés’.
La nueva norma actúa en tres vías. Por un lado, propone este segundo y nuevo Código de Buenas Prácticas de carácter transitorio, para proporcionar alivio a deudores de clase media en riesgo de vulnerabilidad por la subida de los tipos de interés, intentando facilitar una adaptación más gradual al nuevo entorno de tipos de interés. También modifica el primer Código de Buenas Prácticas propuesto en el Real Decreto-ley 6/2012, de 9 de marzo, con el fin de adaptarlo a la situación actual, ampliando su ámbito de actuación y sus medidas de protección a deudores hipotecarios sin recursos. Finalmente, introduce otras medidas complementarias para facilitar la conversión de préstamos a tipo variable a tipo fijo, también la subrogación de los préstamos entre entidades financieras incentivando así la competencia del mercado, y para promocionar la educación financiera de los deudores en este contexto.
